By accessing our website or engaging our cleaning services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our services.

Important Notice: These terms contain important provisions regarding liability limitations, dispute resolution, and your legal rights. Please read them carefully before using our services.

User Obligations and Responsibilities

1. Property Access and Safety

As a user of our cleaning services, you are responsible for:

  • Providing safe and secure access to the property requiring cleaning services
  • Ensuring the property is free from hazardous conditions or materials that could endanger our team
  • Disclosing any known safety concerns, structural issues, or unusual conditions
  • Securing valuable or fragile items before our team arrives
  • Restraining pets that may pose a risk to our team members

2. Accurate Information

You agree to provide truthful, accurate, and complete information when booking our services, including property details, specific cleaning requirements, access instructions, and contact information. Failure to provide accurate information may result in service delays, additional charges, or service cancellation.

3. Conduct Requirements

You must:

  • Treat our team members with respect and courtesy at all times
  • Refrain from harassment, discrimination, or abusive behavior
  • Not interfere with our team while they perform their duties
  • Respect professional boundaries
  • Report concerns through proper channels rather than directly confronting team members

4. Payment Obligations

You are responsible for ensuring timely payment according to agreed terms. This includes maintaining valid payment information, authorizing charges for services rendered, and promptly addressing any billing discrepancies. Failure to meet payment obligations may result in service suspension or termination.

5. Compliance with Laws

You agree to comply with all applicable local, national, and international laws and regulations in connection with your use of our services. This includes but is not limited to employment laws, health and safety regulations, and data protection requirements.

6. Indemnification

You agree to indemnify and hold harmless Clearview, its employees, and contractors from any claims, damages, or expenses arising from your breach of these terms, your violation of any law or rights of others, or unsafe conditions at your property that you failed to disclose.

Liability Limitations and Warranties

Important Legal Notice: The following provisions limit our liability and define the warranties we provide. These limitations are essential parts of the agreement between you and Clearview.

1. Service Warranties

We warrant that our services will be performed:

  • With reasonable skill and care by trained professionals
  • In accordance with industry standards for cleaning services
  • Using appropriate cleaning products and equipment

This warranty does not cover damage resulting from pre-existing conditions, normal wear and tear, improper use of cleaned areas immediately after service, or conditions beyond our reasonable control.

2. Disclaimer of Warranties

Except as expressly stated above, our services are provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that our services will meet all your specific requirements or that they will be completely error-free.

3. Limitation of Liability

To the maximum extent permitted by law, Clearview's total liability for any claims arising from our services shall be limited to:

  • The amount paid for the specific service giving rise to the claim, or
  • £500, whichever is lower

4. Exclusion of Consequential Damages

In no event shall Clearview be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, whether based in contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

5. Exceptions to Limitations

Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

6. Insurance Coverage

We maintain appropriate insurance coverage for our business operations. However, this insurance does not extend our liability beyond the limitations stated in these terms. You are encouraged to maintain your own property insurance.

Legal Information and Dispute Resolution

1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.

2. Jurisdiction

You agree that any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, we retain the right to bring proceedings in the courts of your country of residence.

3. Dispute Resolution Procedures

Before initiating formal legal proceedings, parties agree to:

  • Attempt to resolve disputes through direct negotiation in good faith
  • Provide written notice of the dispute with reasonable detail
  • Allow 30 days for informal resolution efforts
  • Consider mediation before pursuing litigation

4. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

5. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Clearview regarding the use of our services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

6. Waiver

No failure or delay by Clearview in exercising any right, power, or privilege under these terms shall operate as a waiver thereof. Any waiver of any provision of these terms will be effective only if in writing and signed by an authorized representative of Clearview.

7. Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations under these terms without restriction, including in connection with a merger, acquisition, or sale of assets.

8. Force Majeure

Neither party shall be liable for any failure to perform its obligations under these terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, governmental actions, or public health emergencies.

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated through our website or by direct notification. Your continued use of our services following such changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must discontinue use of our services.
